Please read these Terms carefully before using the Safex Transport website. They govern your access to and use of safextransport.ca.

1.Acceptance of Terms
By accessing or using the Safex Transport website (safextransport.ca), you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this website.
These Terms apply to your use of this website only. They do not constitute a contract for transportation services, which is governed by separate freight agreements, bills of lading, and applicable tariffs.
2.Intellectual Property
All content on this website — including but not limited to text, graphics, logos, photographs, videos, icons, and software — is the exclusive property of Safex Transport Inc. or its content suppliers and is protected by the Copyright Act (Canada) and other applicable intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content from this website without the prior written consent of Safex Transport Inc., except as follows: you may print or download a single copy of pages for your personal, non-commercial use.
3.Acceptable Use
You agree to use this website only for lawful purposes and in accordance with these Terms. You must not:
- Use the site in any way that violates applicable federal, provincial, or local laws or regulations
- Transmit any unsolicited or unauthorized advertising or promotional material
- Impersonate any person or entity or falsely state your affiliation with any person or entity
- Interfere with, disable, or disrupt the security, integrity, or operation of the website
- Attempt to gain unauthorized access to any part of the website or its related systems or networks

4.Disclaimer of Warranties
This website is provided on an "as is" and "as available" basis, without any representations or warranties of any kind, express or implied. Safex Transport Inc. makes no representations or warranties regarding the accuracy, completeness, reliability, or suitability of the information contained on this website for any purpose.
Information about services, capacity, rates, and availability is for general informational purposes only and does not constitute a binding offer. Actual terms and conditions applicable to transportation services are set out in our freight agreements and applicable tariffs.
5.Limitation of Liability
To the maximum extent permitted by applicable law, Safex Transport Inc. shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to your use of, or inability to use, this website — even if we have been advised of the possibility of such damages.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

Our website may contain links to third-party websites for your convenience. These links do not imply our endorsement of, or affiliation with, those sites. We have no control over the content, privacy policies, or practices of any third-party sites and accept no responsibility for them.
7.Governing Law and Jurisdiction
These Terms of Use are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law provisions.
Any disputes arising from or relating to these Terms or your use of this website shall be subject to the exclusive jurisdiction of the courts of the Province of Quebec, District of Montreal.
8.Changes to These Terms
We reserve the right to modify these Terms of Use at any time. Changes will be posted on this page with an updated date. Your continued use of the website after any changes constitutes your acceptance of the revised Terms.
9.Service Pricing & Quotations
- Price and service agreement is based on dimensions, weight, and number of pieces at time of booking.
- The quoted prices are valid for a period of thirty (30) days from the date of quotation, or the period agreed upon. The Company will re-quote if requested.
- All quotes are subject to equipment availability, permit approval, and seasonal road restrictions. The Carrier does not guarantee it can move the load(s) within the Customer's schedule.
- The quoted price is conditional on site accessibility for our equipment. It is the customer's responsibility to provide clear access in and out of site. The Carrier is not responsible for damage to access routes or roads due to the weight of the loaded vehicle.
- All orders pursuant to the quotation are subject to credit approval by the Company.
- Fuel surcharge (whether included or extra) is variable and could change at any time.
- The receipt of a Purchase Order signifies acceptance of the quote and the beginning of the permit approval process. In the event of cancellation after confirmation, the Customer is responsible for all costs incurred on their behalf up to that point.
- All rates and charges are subject to all applicable government taxes, which are extra.
- Price does not include customs clearance.
10.Accessorial & Extra Charges
- Accessorial Charges (if applicable) — written confirmation of acceptance required before load is delivered.
- Tarping (if added after initial commitment): Legal load $75.00, Permitted load $125.00.
- Additional pick-ups or drops (if not part of original agreement): $60 plus additional mileage.
- Missed pick: $250 plus mileage related to moving towards the agreed upon load.
- Layovers: $500 per day (legal) and $750 per day (permitted), plus escorts if applicable.
- Waiting time: Legal loads $95/hour, Permitted loads $135/hour — applies to loading/offloading time.
- Dunnage: to be provided by Shipper. If provided by Safex, cost plus 20%.
- Escorts: Cost plus 15%, unless already included in the agreed upon price.
- Police Escorts: never part of the agreed upon price — Cost plus 15%.
- County permits are not included; costs will be billed at cost plus 20%.
- Utilities and bridge surveys are extra if required, unless expressly stated in the quotation, at cost plus 20%.
11.Permits, Road Surveys & Special Operations
- The cost of necessary permits based on dimensions, weight, and number of pieces at time of quote is included, subject to approval from governing authorities. A minimum of five (5) business days' notice is required to order permits.
- If new permits are required due to inaccurate information provided by the customer, additional costs will apply.
- Private escort costs are included based on estimated routing, to be confirmed upon receipt of routing and applicable state/province DOT regulations. Any additional escort costs will be billed accordingly.
- The cost of road surveys based on dimensions, weight, and number of pieces at time of quote is included. Additional costs apply if new surveys are required by regulating authorities.
- Police escort costs are not included and will be charged at cost + 15%.
- Accessorial fees apply as per schedule for services such as tarps, waiting time, layovers, dunnage, etc.
12.Loading, Unloading & International Shipments
- Loading and offloading of trailers is the responsibility of the shipper and consignee, unless otherwise specified.
- The Shipper is responsible for any blocking or bracing required, unless otherwise specifically indicated.
- Unless otherwise specified, two (2) hours have been allotted for loading and offloading of the trailer.
- Additional time for loads up to 12 ft overall width, 14 ft overall height and 80,000 lb GVW will be billed at $95/hour, up to a maximum daily rate of $950.
- Additional time for loads exceeding 12 ft overall width, 14 ft overall height or 80,000 lb GVW will be billed at $135/hour, up to a maximum daily rate of $1,350.
- For international shipments requiring customs pre-clearance, paperwork must be available in advance to avoid border delays. Any customs-related border delays will be billed at the applicable rates with no free time allowance.
- Cargo must be clean and free of any dirt, soil, or oil for border crossings. Any cost or time incurred to clean equipment will be invoiced at cost plus 20%.
13.Delays, Liability & Disputes
- The Carrier will not be held responsible for delays due to any reason beyond our direct control, including inclement weather, acts of God, detours, route closures, equipment failure, or delays due to government authorities.
- Safex Transport is not and will not be party to any penalty clause that the manufacturer, shipper, or logistics coordinator may be bound to.
- Delays due to unforeseen circumstances beyond our direct control — including extreme weather — that require additional work or equipment may result in a change in pricing.
- The Carrier assumes no responsibility for the operational performance of the cargo being transported.
- The Carrier will not be held liable for any concealed damage. If the exterior of the piece or crate is undamaged, any damage inside is not the responsibility of the Carrier.
- Maximum Carrier responsibility is $2.00 per pound based on actual cargo weight, up to a maximum of $1,000,000 for damaged or lost cargo in our direct care, custody & control. No responsibility is assumed over $2.00 per pound unless a higher value is declared and additional insurance is agreed upon before service commences.
- There is no declared value to the merchandise. Additional insurance can be offered at competitive rates.
- Customers are responsible for damage or theft of Carrier equipment dropped at origin or destination.
- If a dispute should arise, the Laws of Quebec, Canada will be applied unless otherwise agreed to by contract.
- Any item not mentioned in the quotation is NOT INCLUDED.
